ICAN Acoustics provides a wide range of services to Legal Professionals and private individuals pursuing a legal resolution to a noise problem. We provide these services particularly in the area of noise nuisance investigation and assessment, which in many cases can result in attendance at court.
The law in Ireland (with the exception of N.I.) governing the area of noise control is contained in Section 108 of the Environmental Protection Agency Act 1992 and the Environmental Protection Agency Act (Noise) Regulations 1994 (SI No. 179 of 1994). While the law in Ireland does not specify a level or any definitive guidance, it is clear that if noise is affecting a person or persons' quality of life, they have a right to expect something to be done about it. The EPA guidance details a 55dB(A) daytime level and 45dB(A) night time level, which is not always appropriate or relevant to many situations.
In the absence of any definitive guidance here in Ireland on the acceptability of relative levels, ICAN Acoustics rely on number of relevant British Standards, World Health Organisation guidance and Code of Practice documentation to support a legal case.

It is advisable that a suitably qualified acoustic consultant is used to represent you or your client in a court of law. Diarmuid Keaney of ICAN Acoustics holds a MSc. in Applied Acoustics (of distinction), a Diploma in Acoustics and Noise Control (Merit) as well an Honours Engineering Degree (2:1) from the National University of Ireland. Diarmuid has experience and training as an Expert Witness in a large number of court cases, arbitration hearings and planning oral hearings for major projects.
